Needing to cut staff is a painful process as those colleagues one has decided to terminate often take the news personally or feel unjustly victimized or insufficiently appreciated.

Here are some guidelines for that unpleasant meeting in which you announce the unfortunate news that the company will no longer require your subordinate’s services.

1)  Prepare yourself in writing
You should have a short document prepared in which the reasons for the employee’s termination are clearly enumerated and the conditions of termination are clearly spelled out. You should have a work certificate already prepared and all financial arrangements already formulated.

2)  Prepare your message
Write out the ‘script’ that you intend to follow during the termination interview and also what you intend to say to the rest of your remaining team.  Stay brief and stay on subject.

3)  Prepare the follow-up steps
Meetings should be set up with your HR department as well as your jurists.  Make sure your terminated employee has handed over all relevant dossiers and company property.

4)  Shield yourself emotionally
Don’t take anything personally.
Remember that your role objective is the survival and prosperity of the company. The decision you have taken is rational, not emotional. Accept that you will be somewhat anxious and discuss the decision if necessary with your hierarchy or with HR.

5)  Anticipate your Employee’s reactions
People rarely react calmly to being told they are being terminated.  On the contrary, they can become angry, frustrated,
irrational, tearful. Understand that and prepare yourself to take the shock of their reaction and manage it as best you can.

To Do
Invite your employee to have a seat
Get right to the point
Explain your reasons
Wait for his reaction and listen attentively
Re-explain your decision if necessary
Be clear on the date of the end of the contract and on the time at which he must leave the company premises.
Give an overview of the departure/separation conditions
Do not overextend the meeting — the meeting should take no more than 15 minutes.

Don’t make friendly greetings like ‘Hi, how’s it going? or ‘Pleasure to see you’”
Don’t make small talk
No humor either
Don’t defend yourself, don’t justify yourself, don’t raise your voice
Don’t threaten
Do not discuss the future of other colleagues

Don’t try to minimize the situation
Don’t take take his reaction personally
Refrain from platitudes (no remarks like, ‘I understand what you must be feeling…’, ‘you’ll see, it will all be OK…’ , etc)

Here is what might happen on site:

1. Prepare thoroughly for the interview. Gather extensive information about the company. Don’t give the impression of having just got off a flying saucer or that don’t care about being invited! To be well-prepared requires that you also plan your travel to arrive on time, dress appropriately, etc. Think carefully about how to present your assets and prepare your own questions.

2. Your state of mind: you have an opportunity for an interesting conversation with a person who needs to feel of interest too. Be happy and positive. It is a worthwhile experience. You will meet someone, learn about a company and get to know more about the job; in addition you will  refine your sales skills through marketing yourself.

3. Talk in a decided tone, greet with a smile and
shake hands neither too soft nor too strong. A few words
kind, some light conversation. Being natural always
gives the best impression. Being natural does not mean being rude!
It is worth training to introduce yourself to others.

4. Concentrate on the first few minutes. There is evidence that it is during
the first four minutes that’s one creates an impression, either of sympathy or antipathy.

5. Be careful of what you are saying. Watch your flow words and complete sentences to give the impression of having everything under control. Look your interviewer in the eyes, even if thick glasses make them difficult to find.

6. Do not interrupt.

7. Even if the job description bores you to tears, show your interest by asking questions if you nevertheless need a job.

8. Do not monopolize the conversation. Observe your interviewer, and if you note some impatience, shorten your questions.

9. Do not show humble or arrogance, don’t be  too stiff or too confident, you should behave as if you were talking to a trading partner.
You did not come to beg and you have something to offer.

10. Do not forget the essential goal of the interview: do not just
answer questions, take the opportunity to “sell” your skills and achievements.
Add concrete examples.

Be honest and remember that lying requires an excellent memory and is tricky as people can check what you are saying…
Of course, it helps when you can convince yourself before convincing others…

To turn those 10 rules into a golden job, do not forget that:
- It is quite possible that the personal assistant is watching you. Many leaders attach great importance
 to the intuition of their secretary… Needless to say that you should arrive on time for the interview (about 10 minutes in advance to concentrate)
- Reserve and discretion: never criticize a former employer. Bad mouthing your former employers or superiors will create the negative impression that you will be equally disloyal to your next company.
- Don’t offer your interviewer a breath mint, unless you need some for yourself…

Localisation: 

Après une vigoureuse reprise des ventes de luxe au premier trimestre 2010, l’environnement s’était assombri avec les plans d’austérité qui se profilaient en Europe et avec la chute des marchés boursiers intervenue mi-avril dernier. Le joaillier italien Bulgari a estimé que le marché européen devrait rester difficile et que l’impact des mesures d’austérité face au mur de la dette se ferait surtout sentir en 2011. En même temps, La Prairie avait dit pour sa part ne pas anticiper avant 2012 un retour à ses niveaux d’avant la crise, tandis que pour Cerruti, les marchés français et italiens pourraient terminer l’année sur une note stable. L’horloger Hublot, filiale du numéro un mondial du luxe LVMH, s’est lui aussi dit prudent pour l’année malgré un très fort rebond des ventes de montres en début d’année. L’Europe compte pour environ un quart du marché mondial du luxe.

La foire de SIHH est un baromètre de la santé du secteur et la foire a confirmé les commandes en hausse et un retour en bonne santé, largement due aux économies en Asie. Le marché asiatique talonne désormais les marchés européens.

Richemont (qui possède les marques Cartier, Montblanc, IWC, et autres) a affiché une hausse des ventes de 23%. Entre octobre et décembre 2010 le groupe a réalisé un chiffre d’affaire de EUR 775 million, en progression de 43% sur la même période l’année dernière.

Tous les acteurs ont dit que c’est en Chine que la croissance des ventes du secteur a atteint souvent 20%, voire plus, et les économistes ne font pas de scénario de fort ralentissement de sa croissance. Le pays, devenu l’eldorado des groupes de luxe malgré des difficultés administratives et bureaucratiques, verra ainsi l’essentiel des ouvertures de boutiques.
La zone euro est un marché important, mais la réserve de croissance se trouve aujourd’hui dans les pays émergents et notamment en Chine, dont la demande tire l’ensemble du secteur.
Le consommateur chinois, pour qui luxe rime avec Occident, est devenu le premier consommateur du secteur — en comptant les achats réalisés dans le pays et ceux liés au tourisme — comptant pour environ 25% des ventes mondiales, devant l’Américain, l’Européen et le Japonais (à parts sensiblement égales de 20%).

Au SIHH, les directeurs de plusieurs marques ont fait le même constat: “la reprise est bien là.”

The Language
The EU now encompasses a dozen different languages. If you move to an English speaking country like England or Ireland, your adjustment will the easiest. A native English speaker must nonetheless adjust to things like different tax systems and social norms. Non-EU nationals may obtain the right to work in an EU country. The ease of doing so depends on nationality and status and is determined by different agreements and other EU rules.

Background – Are you in IT or Some Sort of Academic Research?
The IT field is in demand and one can find work fairly easily, even without the native language. Many tech positions in Germany and Switzerland require only English.
If one speaks English and has the required competencies, one will have a good chance of finding work in Europe.

If you’re from an academic research background, this also helps. English is usually the international work language for research in academic situations and you can adjust fairly well.

Background – Business an Advantage
More and more companies have English as their company language. If you have a background in business or a related degree, you will have a greater chance of finding employment. However, most often, in Germany, in Switzerland, in France, in Italy, even in Austria or Scandinavia, you will be expected to eventually learn the language. Even if English is the official company language, people do speak the local language and you will need to fit in as well as succeed in the long term in your job. This is likely to be a major challenge, if not the major challenge: learning a language takes time, commitment and discipline.

High Competition
If you are not from an IT, Scientific / Academic, or Business background, and do not have a specialized education, you will encounter very high competition for jobs, even with a mastery of the language.
Europe has many immigrants, and they are competing for the same jobs.

The ‘English Teacher’ Fallback
Many native English speakers think they can rely on being an English teacher as a fallback. This is not really an option, unless you are prepared to live like a student.
Finding decently remunerated work as an English teacher will usually require your having important credentials in this area.

All citizens of the EU, plus Switzerland, have the right to move all around and work anywhere in the European Community that they want. (It’s not too clear what Switzerland had to gain in this arrangement since it has the highest standard of living, so the only Swiss considering leaving Switzerland to seek jobs in the EU are the ones on unemployment.)

However, when an American, Canadian or a New Zealander come to Europe to find work, he has to find an employer that will sponsor his work permit. The first few months while he’s going through that job hunting process, he may have to work “black,” meaning he may have difficulty getting paid because his work and residency in the country have not yet been approved.

Getting a work permit is a constant topic of conversion among the expatriate crowds in Berlin, Vienna, Rome, Zurich, Geneva, Paris, and Barcelona. The exchange of visa horror stories and grand schemes of getting away with overstaying – everyone has a nightmare story of being escorted to the border by the immigration authorities. Some contemplate proposing marriage to the random attractive native they met at a bar the week before, others gave up and return to their home country, and still others persevere and deal with the process and the paperwork.

Acquiring a work permit in Europe is a challenge but a good skill set, perseverance and some personality will help you do the trick.

Ce phénomène s’applique également à l’éducation, l’armée, la politique et aux entreprises.

Parlons de la façon dont ces changements qualitatifs affectent le secteur de la consultation. Pour les grandes entreprises, la satisfaction du client est en panne et le client “loyal” est au bord de l’infidélité constante, tellement il est bombardé par d’autres alternatives.

Peters envisage que la technologie provoquera l’extinction d’externalisation, ou même, d’une grande partie de la force de travail des cols blancs traditionnels. La situation est paradoxale: les consultants seraient à la fois condamnés par cette révolution technologique tout étant encore plus sollicités grâce à leurs services à valeur ajoutée. Nous voilà confus mais aussi rassurés!

Pour survivre en tant que membre d’un ministère ou organisme, vous devez vous transformer en une version micro de cette organisation. Vous devez devenir quelqu’un qui donne assurément de la valeur ajoutée du travail en plus de facturer ses prestations. Quel est l’impact sur les services professionnels, comme les consultants? Il leur faut encore plus re-imaginer ou réinventer mais de manière encore plus significative car tout le monde doit se mettre à re-imaginer son quotidien pour survivre professionnellement.

Peters encourage la créativité qui “exige le désordre, le non-respect des règles et la tolérance des échecs”. Il va sans dire que l’état de tension chronique au travail, une charge de travail excessive ou un sentiment d’insécurité ne dopent pas la créativité sur le long-terme mais plutôt comme une stratégie ponctuelle de survie.

Peters pense que nous allons devenir une nation de consultants. Peut-être le sommes-nous déjà! Si IBM est maintenant IBM Global Services et UPS est UPS Logistics au lieu d’un groupe de types avec des camions, c’est que tout succès découle de la valeur ajoutée de ce “capital de consultation intellectuelle”.

Alors que les gens pensent que perdre des emplois industriels au profit la Chine est un problème, Peters relève que les emplois que nous perdons dans le secteur des services est un enjeu beaucoup plus important…

Null doute que nous avons désespérément besoin d’idées, ne serait-ce que pour nous ré-inventer!

La dernière enquête Universum des employeurs idéaux 2010 révèle que les futurs diplômés d’écoles de commerce, d’ingénieurs, d’universités en sciences naturelles/santé préfèrent, dans l’ordre, LVMH, EADS et Sanofi-Aventis.  La même étude démontre que l’objectif majeur de carrière des jeunes demeure l’équilibre entre la vie privée et la vie professionnelle. 

Pour les étudiants en écoles de commerce LVMH reste la meilleure entreprise, talonnée de près par l’Oréal.  Diverses raisons sont citées pour ce choix, parmi lesquelles, la variété des métiers proposés et la diversité des profils recherchés.  Aussi, LVMH offre-t-il des stages pensés en vue d’un pré-recrutement et propose des projets de vie très attractifs en Asie Pacifique, aux Etats-Unis, en Amérique du Sud, en Europe ou en Russie. 

En 2010,  Google s’est positionné sur la 3e marche. Après avoir fait son entrée directement à la 17e place en 2008, Google remplace Air France du Top 3, qui est tombée à la 5e place. De leur côté, Canal + et Danone se maintiennent respectivement à la 4e et à la 6e place. Nestlé a aussi grimpé les échelons, arrivant à la 7e place.  Le responsable de marketing  chez Universum France note que l’agroalimentaire attire de plus en plus les profils commerciaux, depuis la crise.  Autre surprise, Veolia Environnement prend la 10eme place.

Pour les ingénieurs, EADS continue de dominer le classement, et Veolia Environnement conserve sa seconde place. En 3e place, Google a profité d’un fort engouement au détriment d’EDF qui a perdu, cette année, deux places,  arrivant à la 5e position.  Les enquêteurs notent que les jeunes ingénieurs semblent être attirés par des secteurs  comme le High Tech; l’intérêt des ingénieurs pour le secteur de l’aérospatial et la défense se confirme en 2010. Thales s’est retrouvé à la 4e marche, montant de deux rangs.

La vue est différente pour les étudiants en sciences naturelles/santé.  Sanofi-Aventis reste quand-même le leader incontesté, mais le Centre national de la recherche scientifique (CNRS) a fait son entrée directement à la seconde place — une première pour un organisme public de recherche. Pfizer est tombé de la 3e place à la 5e position. Nestlé est également présent dans le Top 10 à la 6e marche des meilleurs employeurs des étudiants en sciences naturelles/santé. Veolia Environnement demeure au 7e rang. Google arrive aussi dans le Top 10.  Thales atterrit à la 9e position.

Malgré ses déboires, cette année la banque a retrouve son essor, au détriment des cabinets de conseil et d’audit. Les constructeurs tels que PSA Peugeot Citroën (16e) et BMW (19e)  ont perdu respectivement 4 et 6 places tandis qu’Ubisoft a gagné 11 places (25e) et Microsoft 6 rangs (13e).  

L’étude était réalisée en début 2010  auprès de 21’000 étudiants, issus de 100 grandes écoles de commerce (11’000), d’ingénieurs/IT (9’000) et de sciences naturelles/santé (1’000).  Moyenne d’âge des participants : 22 ans.

Mais votre travail vous ennuie — vous êtes bloqué, tout est devenu routinier, il n’y a plus de challenge, et vous cherchez ailleurs.

Comment partir, “sans casse” pour vous comme pour l’entreprise, comment faire en sorte de rester en bons termes tout en assurant le passage de relais ?

Tout d’abord, prévenez votre entreprise le plus vite possible. Une fois que vous avez l’autre proposition en main, prévenez votre DRH.

Le premier faux pas qui ferait des dégâts serait qu’ils apprennent votre départ par un tiers. Vous seriez alors en mauvaise position pour négocier votre départ. Faites-le oralement puis confirmez-le par une lettre de démission que vous adresserez en courrier recommandé avec accusé de réception.

Votre lettre devra contenir un certain nombre d’informations afin d’éviter par la suite toute contestation : votre état civil, une phrase indiquant clairement votre souhait de démissionner et la date de votre départ, compte tenu de la période de préavis, enfin une phrase indiquant quel poste vous occupiez, et éventuellement depuis quelle date. Vous n’avez pas besoin de motiver votre démission dans votre courrier.

Il n’y a pas de règles pour rédiger une telle communication, mais il est élégant d’expliquer clairement les raisons de votre départ, sans parler en mal ou en étant trop critique envers l’entreprise que vous quittez.

Une démission peut parfois être perçue comme une trahison. Une bonne lettre, efficace et courtoise, sera sans doute mieux vécue de part et d’autre et démontrera à quel point cette opportunité est importante pour la suite de votre carrière et pour l’accomplissement de vos projets professionnels.

Une technique rhétorique souvent employée et de suggérer à votre responsable ou à vos collègues de se mettre à votre place en leur posant la question « qu’auriez-vous fait à ma place ? ».

Dans le cas ou votre employeur vous a mis au placard ces dernières années, vous pouvez lui écrire que vous démissionneriez en échange d’une formation ou d’une indemnité.

Autrement dit, dans bien des cas, un départ se négocie.

Encore une fois : soyez calme et poli. Ne déversez vos récriminations sur les collègues de manière désobligeante et gardez pour vous vos commentaires sur l’incompétence du haut management car cela ne sert à rien et en dit plus sur vous que sur l’entreprise.

Une vie professionnelle est longue et il est forte probable que vous allez recroisez vos anciens collègues ailleurs dans l’avenir. Peut-être vont-ils retravailler avec vous en tant que fournisseurs, clients, ou partenaires.

Il n’est pas exclu que dans quelques années vous reviendrez chez votre employeur pour une nouvelle opportunité…

Le profesionnel supérieur sait garder toutes ses portes ouvertes. Il est muni non seulement des compétences techniques mais d’un savoir-faire relationnel.

Rendez-vous disponible pour la passation de pouvoir. Formez votre remplaçant, quitte à travailler en binôme pendant un moment. La direction de l’entreprise que vous quittez et le collègue ou les collègues qui vous remplacent vont apprecier votre sérieux et votre fiabilité, traits qui sont prisés dans le monde des affaires.

Bien que la durée de votre préavis soit fixée par convention, elle reste toutefois négociable. En plus de l’entachement à votre réputation, le refus d’effectuer votre préavis pourrait se solder par le versement de votre part d’une indemnité à votre employeur. En conservant de bonnes relations avec votre responsable et votre ancien entreprise, vous êtes en position avantageuse pour partir dans les meilleures conditions.

Si vous souhaitez quitter votre entreprise mais n’êtes pas certain de retrouver un poste immédiatement, négociez une rupture conventionnelle avec votre employeur. Ce cas de figures n’est pas le même que celle du licenciement ou de la démission.

En plus, il donne droit au versement d’une indemnité de rupture et à l’indemnisation par les Assedic.

Cette strategie convient plutôt aux cas difficiles. Son principe est celui ci : vous convenez avec votre employeur des conditions de la rupture du contrat de travail, qui donne lieu à la signature d’une convention. La convention doit mentionner le montant de l’indemnité spécifique de rupture conventionnelle, et celle ci ne peut être inférieure à celle de l’indemnité légale de licenciement. Ces deux indemnités doivent être supérieures à 1/5 de salaire par année d’ancienneté, montant auquel s’ajoutent 2/15e de mois par année après 10 ans d’ancienneté.

Dans le cas ou vous êtes enceinte, vous êtes dispensée d’effectuer le préavis, de même au terme de votre congé maternité, à condition d’informer votre employeur de votre démission par lettre recommandée avec accusé réception au moins 15 jours avant la date prévue pour votre retour dans l’entreprise.

Il est impossible par contre de démissionner d’un contrat à durée déterminée (CDD). Seuls l’accord à l’amiable, la faute grave, la force majeure ou encore l’embauche sous contrat à durée indéterminée de l’intéressé, sont admis pour rompre un tel contrat.

Switzerland is becoming a popular destination for masters student seeking jobs or research opportunities or universities at which to do their PhD thesis.

The doctoral degree — Doctor of Philosophy, abbreviated to PhD, Ph.D. or D.Phil — is an advanced academic degree awarded by most of top-tier universities. In general, across Europe and North America the PhD or equivalent has become a frequent career requirement in science, technology, or even finance. Of course it had always been a requirement for acceding to a professorship at a university. In Switzerland, doctoral programs vary at the 12 top Swiss universities.

Recognized PhD titles are only awarded by these 12 official universities. Universities of applied sciences do not award doctorates. Usually the prospective doctoral student must have his research work accepted by a professor at one of the 12 universities.

PhD work is started immediately after the master theses (students are usually 25 – 28 years of age). On average, PhD candidates finish at 31. Unlike elsewhere in Europe, Swiss PhD candidates are supposed to start on their research project right away; classes are usually dispensed with. In this manner, Swiss PhD programs resemble more an autonomous work environment than they do an educational institution.

As is largely the case with the rest of the EU, you cannot enroll in a PhD program without a recognized Masters degree. Further, each university has its own admission requirements. The duration of doctoral studes/projects is nonstandard and can vary from between 2 – 6 years depending on the chosen field of research. While PhDs in sciences can often be accomplished in 4 years, PhDs in the arts and humanities can often take 4 to 6 years or longer.

Candidates for a PhD typically sign on as research assistants/PhD-candidate at a university; occasionally some students manage to obtain a research position with an international company and attach their project to a University. Salaries vary significantly with some slots paying as little as CHF 2000 and other paying more than CHF 6000.

It depends on the source of the funding. Further, working conditions will vary from institution to institution. Doctoral candidates are usually employed part-time and sometimes the remaining time can be used for research; other times the PhD candidate is required to give lectures or to supervise students. The contract will specify this.

If you are employed less than 100%, you are legally free to do use the remaining ime as you please, for example by taking on a second job, a common occurrence with candidates from the arts and humanities.

It bored us every day.Our boredom was ongoing, a collective boredom, and it would never die because we would never die.”

Researchers in the Netherlands have conducted a study among 1500 women across various professions to determine the frequency with which sex enters into the workplace.

In Holland, the studies found that more than one-third of women had had a sexual relationship with a colleague at work (other than their habitual partner if their partner works at the same company).

90% of those surveyed said that at least one of their work colleagues attracted them physically. Roughly 15% of those surveyed responded that they would be capable of using sex to obtain a promotion, with the reservation expressed that their boss attracted them.

In response to the question, “how would you react to a colleague putting his hands on your backside,” 3 in 10 responded that it depended on which colleague took this particular liberty.

Similar studies in the UK reveal that more than 1 in 3 female professionals have had a sexual relationship with a colleague at work, with 16 % of surveyed women indicating that they could be inclined to sleep with the boss for a promotion.

In France, roughly 25% of women have indicated having had a sexual relationship with a colleague at work and 14% of women surveyed indicated that they could conceivably sleep with the boss to secure a promotion.

Interestingly, the authors of these studies consistently focus on women. No studies have yet been published indicating what percentage of men would we willing to sleep with the boss in order to secure a promotion.

Dans bien des corps de métiers, on relève un manque de motivation, un sentiment de frustration, de la fatigue, du stress contre-productif, une pression destructrice, etc. Force est de constater que la perte d’initiative et la perte de créativité sont générales, ce qui a des conséquences humaines mais aussi économiques, que cela soit pour l’entreprise ou la société.

Il est grand temps que les cadres dirigeants prennent en compte cette réalité et s’attaquent aux systèmes qui conduisent à de tels gâchis. Il faut remettre de l’envie dans les organisations, donner aux hommes et aux femmes des raisons de « se bouger », de s’impliquer. Le salarié a besoin d’être écouté pour se sentir entendu. Si ce n’est pas par pur philantropie, le jeu en vaut la chandelle d’un point de vue économique car les performances sont bien meilleures quand les employés ont le sentiment d’avoir prise sur leur travail au lieu d’une exécution passive…

Face au développement général du stress et des tensions au travail, les approches traditionnelles de la communication interne sont totalement dépassées. Il ne suffit plus d’avoir de bons outils (intranet, conventions, etc.), il faut d’abord et surtout avoir une vraie stratégie, ce qui , presque partout, fait encore cruellement défaut… Peut-être faut-il commencer par donner une vision, une direction claire à l’enteprise et “l’intendance suivra”, pour reprendre l’expression du brillant général !

Financial news services in Switzerland are all reporting a sharp rise in the number
of job vacancies between June 2009 and May 2010, with UBS and Credit Suisse accounting for the majority of new jobs and employment opportunities (consultancies have also risen but are not counted in the figures).

On the other hand, the survey show stagnation in the insurance industry. According to the financial news agencies banks are increasing their staff because they have lowered their overall operating costs. In the insurance industry, such cost restructuring has not yet taken place.

Meanwhile the Swiss government accord with the USA for the handover of UBS accounts to the American tax authorities is set for approval by the Swiss parliament, despite the agreement’s being illegal under Swiss law. Many representatives in Swiss parliament expressed frustration at having to choose between foreign engagements undertaken by the executive and Swiss law.

Management is art and it is science:

It is the art of making people more effective than they would have been without you.
The science is in how you manage to do that.

There are basic pillars:

• Goal to achieve: define the target and figure out the best way to get there.
• Analyse : What are your resources ? What can you get? Compare strengths and weaknesses of individuals. Look at all the probable scenarios and evaluate your different plans and develop what seems to be the best option. Don’t forget to ask the people doing the work for their input and also think of the worse case scenario.
• Plan: Good management starts with good prior planning and the track record of accomplishments are part of your success.
• Organize: Do the legwork to make sure everything needed to execute the plan is ready to go, or will be when required. Check back to make sure that everyone understands their role and the importance of their contribution to the overall success. Conveying motivation is the key of your future success.
• Direct: Tell people what they need to do and coordinate the actions.
• Monitor: You have to keep an eye on your staff, checking that everything is going according to the plan; you might have to step in to adjust the plan whenever necessary.
• Don’t relax your attention: Problems will come up: someone will get sick or be dismissed; an element won’t be delivered on time; our accounting department won’t have paid an invoice on time, etc. That is why you need to have a contingency plan developed in the first place. You, as the manager, have to be always aware of what’s going on so you can make the adjustments required.

Management is an iterative process:

When something is out of sync, you need to fix it, organize the resources to make it work, direct the people who will make it happen, and continue to monitor the effect of the change.

Managing is necessary:

Managing people is not easy but can be a very rewarding experience.
Like any other skill, management is something that you can improve with study and practice.

Switzerland’s bank secrecy laws forbids financial institutions and intermediaries from transmitting to third parties information about customers. The law dates to 1934 — Article 47 of the Federal Law on Banks and Savings Banks, punishing transgressions with sentences ranging up to 3 years in prison and fines of up to 250,000 francs. Bank secrecy is also a part of contract law, transgressions liable to civil action.

In March 2009 a minor revolution took place with the federal council of Switzerland — its executive — changing the juridic landscape and and modifying the legal framework to conform to Article 26 of the Model Tax Convention of the OECD. The Swiss people have not yet had an opportunity to vote on and ratify or reject the changes made by the executive council of federal government.

Late last month, the Swiss federal government also announced its intention to prohibit the filing in Switzerland of foreign funds not registered with their authority to regulate and tax ‘gray’ money, by which is usually meant undeclared funds.

Banking secrecy exists in several other jurisdictions besides Switzerland, such as the Cayman Islands, Bermuda, Virgin Islands, …,the State of Delaware in the United States, the Bahamas, Andorra, Liechtenstein, and Singapore. Historians claim that Switzerland’s 1934 banking secrecy law was motivated by commercial interests and the interests of tax competition.

Up until its recent repudiation, banking secrecy laws were lifted in some cases, particularly in the context of criminal proceedings, and requests for mutual administrative or judicial. Such requests originated from foreign authorities and targeted a specific customer identified in a designated bank. They were motivated usually by investigation for fraud or money laundering. The recent upsets in Swiss jurisprudence now allow for routine requests from foreign authorities for simple tax evasion or undeclared funds on account.

The lines in the sand have been in continuous movement, with a bewildered, unfocused and irresolute Swiss government currently holding out for a non-automatic exchange of information. At this point Switzerland has agreed to communicate information on request to foreign authorities, but not to send it ‘automatically.’ Similarly, Switzerland has not yet agreed to provide information in transactions known as “fishing expeditions,” where a foreign authority asks for a list of customers without any particular criminal suspicions.

Prior to 2009, Swiss law distinguished between tax evasion and fraud. Therefore administrative assistance was granted only for cases in which fraud was at issue. The simple concealment of funds was not considered a pursuable offense. However, part of the enormous changes that have taken place in Switzerland over the past 12 months are the abolition of this distinction: now the simple neglect to declare funds to a taxing authority, whatever the amount, is considered to be actionable.

Many Swiss-based financiers comment that Switzerland has missed a golden opportunity to strengthen itself as a global financial center, arguing that the OECD’s placement of Switzerland on a ‘gray’ list would be toothless, and would have the added advantage, opposite the intentions of its drafters, of driving great quantities of funds into Switzerland. Most of Switzerland’s banking and financial community does not understand why the government rushed to comply with the OECD’s directives; and many are openly calling the competence of government leaders into question, with councilor Hans Rudolf Merz in particular being singled out for ridicule and contempt in many Swiss newspapers.

Under pressure from the OECD, Switzerland undertook in March 2009 to revise its double taxation agreements with states asking for administrative assistance in accordance with Article 26 of the Model Tax Convention of OECD. Negotiating 12 revised conventions have allowed Switzerland to be removed from the OECD’s ‘gray list’ and receive the gold star of their approval. In fact Switzerland she has renegotiated more than this number of conventions. Additionally, within the generally cloudy juridic context and a weak, uncertain Swiss government, many other scandals have shaken the Swiss banking environment.

In December 2009, an employee at HSBC in Geneva gave French authorities bank data on taxpayers with hidden accounts in Switzerland. Thus France obtained through espionage a list of some 3,000 alleged tax evaders, which it intends to prosecute. It is also free to transmit this data to other States. In February 2010, Germany purchased for Euro 2.5 million another stolen list, containing the data bank of 1500 German taxpayers with accounts mainly at Credit Suisse, apparently stolen by a German national working at the Bank.

Meanwhile, the banking and finance sector in Switzerland has suffered a massive exodus of funds and general panic as the legal environment appears to change from week to week.

The Swiss Bankers Association (SBA) has tried to counter the government’s concessions with a proposal for a “final tax, or withholding tax that the banks would levy and disburse to foreign tax authorities, while ensuring the anonymity of their clients. Compared to existing bilateral agreements with the European Union, this proposed system would extend the tax base to dividends and capital gains. The European Union is not interested in this, but rather seeking the automatic exchange of information.

Seeking to avoid at all costs an automatic exchange of information but apparently unable to formulate such a stance on generally accepted notions of national sovereignty, the government said just recently in late February that it intended to prohibit the placement in Switzerland of foreign funds that had not been duly reported to their country’s tax authorities and that going forward ‘gray’ money would be strictly regulated. The methods for achieving these new goals were not elaborated.

With each new successive demand, the Swiss government has given in and renegotiated previous accords and treaties in place.

Automatic exchange of information would effectively remove the last vestiges that remain of Swiss bank secrecy.

Aujourd’hui, nous allons parler du principe satirique relatif à l’organisation hiérarchique: le célèbre Principe de Peter et son corollaire: « Avec le temps, tout poste sera occupé par un incompétent incapable d’en assumer la responsabilité.»

Dans une entreprise, les employés compétents sont promus et les incompétents restent à leur place. Vous me rétorquerez peut-être que dans votre société, les employés compétents stagnent à leur place, tout comme les incompétents ou que ces derniers s’élèvent dans la hiérarchie. Eh bien, c’est sans doute parce que les incompétents ont été promus dans un premier temps avant d’arriver à leur vitesse de croisière (quand il n’y a pas de vent)…

Aussi, un employé compétent grimpe-t-il dans les hautes sphères de son entreprise jusqu’à atteindre un poste pour lequel il ne sera pas compétent — si ce n’est pas déjà le cas au départ. À ce stade, il devient donc un incompétent qui va occuper son poste indéfiniment. Il va également faire en sorte de ne pas être démasqué en empêchant l’ascension de certains pairs qui pourraient mettre en danger sa planque professionnelle.

Résumons :
- un incompétent conserve son poste (grâce à sa stratégie de survie);
- un employé compétent promu est remplacé par un autre employé, potentiellement incompétent ;
- si le nouvel employé est compétent, il sera promu et remplacé à son tour par un nouvel employé jusqu’à ce que le poste échoie à un incompétent

Une extension ou extension aggravée du principe de Peter est appelée la Loi de Dilbert (du nom d’un personnage de BD créé par Scott Adams). Elle suppose que les employés les moins compétents seront toujours affectés aux postes où on est sûr qu’ils produiront le moins de dégâts, c’est-à-dire l’encadrement. Je sais, vous pensez tout de suite à votre chef direct, n’est-ce pas ? Si vous n’en n’avez pas, vous serez intéressé de savoir comment et par qui vous risquez d’être débusqué…

Laurence J. Peter relève que plus le nombre d’échelons hiérarchiques est élevé, plus chacun risque de subir « la stagnation de Peter ». Il remarque que les hiérarques, quand ils sont au sommet de leur niveau d’incompétence, se complaisent à fréquenter des réunions. Le corps des hiérarques peut alors entrer en « lévitation » sous le nom de « sommet volant ». Comment alors renverser un hiérarque incompétent ? Sachez que seul un hiérarque peut le faire. Mais la problématique est que par cet acte, il admet son incompétence à discerner le personnel compétent puisqu’on l’a laissé grimpé jusqu’au sommet. La solution réside dans le déplacement de la sous hiérarchie du personnel sous ses ordres. Le hiérarque à décapiter se retrouve alors seul à la tête d’une pyramide sans base, sur son « sommet volant ». Il est donc prêt à être destitué par un de ses homologues et à être remplacé par un clone !

Les solutions varient selon les cas :
- Pour un dirigeant constatant qu’il a des cadres supérieurs incompétents, il est conseillé de recourir à ce que l’on nomme la « sublimation percutante ». Cette manœuvre consiste à accorder à une personne incompétente une promotion vers un poste plus prestigieux en apparence, mais en fait à responsabilité très inférieure. Les titres proposés sont inversément proportionnels à leur contenu et à leur niveau de responsabilité. Si c’est en anglais, cela sera sans doute encore plus convaincant : XXX Coordinator, YYY Project Manager, etc.
- Pour les personnes constatant leur propre incompétence, Peter recommande diverses tactiques dont « spécialisation dans le détail » ou « l’aberration totale » qui consiste à arrêter d’essayer d’accomplir son travail. Ces méthodes ne sont pas nuisibles à l’entreprise ou l’organisation, du moment que toute organisation le travail est accompli par les personnes compétentes. Paradoxalement, ces stratégies sont bénéfiques à l’entreprise car les incompétents obnubilés ou amorphes gênent alors moins les travailleurs dans leurs tâches.

Poursuivons avec la loi de Parkinson qui affirme que « le travail s’étale de façon à occuper le temps disponible pour son achèvement ». Cette théorie était basée sur une longue expérience dans l’administration britannique où l’on avait constaté l’accroissement du nombre d’employés au Bureau des affaires coloniales malgré le déclin de l’Empire britannique. L’augmentation du nombre d’employés seraient dû à deux forces :
- « Un fonctionnaire entend multiplier ses subordonnés, pas ses rivaux » : il a une tendance naturelle à recruter quelqu’un de plus compétent que lui au moins dans un domaine, mais aussi à diviser le travail pour éviter d’être remis en cause par l’un de ses collaborateurs. Il crée ainsi des besoins de coordination interne, qui entrainent une charge de travail supplémentaire, puis l’embauche de collaborateurs supplémentaires. On construit ainsi un système « autarcique » qui va consommer, de manière endogène, une part croissante de l’énergie et des ressources disponibles.
- « Les fonctionnaires se créent mutuellement du travail ». Plus il y a de fonctionnaires, plus les demandes d’approbation qu’ils se communiquent mutuellement, ou tâches comparables, les occupent, de sorte que le travail accompli d’un point de vue extérieur par l’administration dans son ensemble n’augmente pas.

Cette tumeur bureaucratique ne se développe que s’il y a déficience en management. Pour y remédier, la seule solution réside dans l’ablation. Il faut donc qu’un manager décide de cette amputation, en supprimant les tâches qui se sont créées. L’externalisation est une des manières de procéder à cette ablation sans couper dans les effectifs. Notons au passage que bien des financiers valorisent l’externalisation en ne reconnaissant pas le temps et le travail nécessaire au suivi des externes par le personnel en interne.

Cyril Northcote Parkinson énonce que variable la plus significative du coefficient d’inefficacité d’un conseil d’administration est le nombre de ses membres… Je ne dirai pas pour autant que le fait de n’avoir que deux personnes à la tête d’un conseil d’administration garantisse une certaine efficacité, car rappelons-nous l’adage « qui se ressemble s’assemble »…

Terminons par la super-compétence qui est plus redoutable que l’incompétence, car tout super-compétent outrepasse ses fonctions et bouleverse alors la hiérarchie qui ne demande qu’à se maintenir. Si tel est votre cas, sachez que pour être renvoyé, il faut que les deux conditions suivantes soient réunies :
- la hiérarchie vous harcèle au point de vous empêcher de produire ;
- vous n’obéissez pas aux principes de « respect de la hiérarchie »

Il est préférable de se maintenir à un poste auquel on est compétent, non seulement dans l’intérêt de l’organisation où l’on travaille, mais aussi parce qu’être compétent à son poste est un facteur de bonheur personnel. Malheureusement, le refus d’une promotion est mal perçu par l’entourage. Espérons que notre « incompétence créatrice » nous permettra de rester à notre place sans risquer d’être sollicité dans de plus hautes sphères où l’on risque de se brûler les ailes, à moins que l’on excelle au point de profiter d’un parachute doré ignifuge.

The last data coming from Mergermarket confirms the trend during the Q4 of 2009 toward acquisitions and mergers to grow market share, a key strategic wind shift from mergers of necessity related to the financial crisis to mergers of opportunity to achieve growth.

According to a survey published in December by Boston Consulting Group and UBS, roughly 20% of the managers surveyed indicated that they were planning a major merger operation for 2010. Merger activity is expected to be largest in the United States. More generally, analysts are expecting 2010 to mark the return to a more normal economic environment, using more traditional modes of financing and less risk.

For such consolidations and restructurings to occur, several factors need to be simultaneously present. First, there needs to be a realistic valuation of companies with an adequate balance of profits and reserves and the measure of taste for risk; a climate of confidence needs to return.

In this context, pharmaceutical companies or companies dealing in raw materials, or financial insitutions will be particularly active and an increasingly preponderant role will be played by companies operating in emerging economies.

Analysts also underline that financing of operations will rely on cash or exchange of stock, though the market expects several more months of cheap money during which time companies can finance their operations with cheap loans.

Les bonnes résolutions sont une coutume de la civilisation occidentale qui consiste, à l’occasion du passage à la nouvelle année le 1er janvier, à prendre un ou plusieurs engagements envers soi-même pour améliorer son comportement, une habitude ou son mode de vie durant l’année à venir.

Le site officiel du gouvernement américain propose même une liste des bonnes résolutions les plus populaires dans le cas où vous n’auriez pas d’inspiration…

Arrêter de fumer, perdre du poids, prendre du temps pour soi, apprendre une nouvelle langue, changer de travail… Vous venez sans doute de prendre vous aussi vos bonnes résolutions…

Mais comment parvenir à les concrétiser ?

Restez humble et réaliste
Ne multipliez pas les objectifs car c’est la meilleure manière de ne rien changer du tout au final.
Fixez-vous un but précis, imaginez comment le mettre en pratique et préparez-vous mentalement à tous les efforts que cela implique.

Admettez les difficultés
Il y a des objectifs plus ou moins difficiles à atteindre ou à maintenir. Parmi ceux-là: trouver un nouveau travail qui vous plaise et où vous êtes reconnu.

Soyez entreprenant
Etablissez un plan d’action concret, en y allant étape par étape: plutôt que de dire cette année, je trouverai un nouvel emploi, dites je vais écrire au minimum trois lettres de candidature par mois et réanimer mon réseau social.

Faites le point régulièrement
Il est bon de faire régulièrement un état des lieux par rapport aux difficultés rencontrées: quelles sont ses forces et ses faiblesses. Au besoin, n’hésitez pas à redéfinir vos objectifs.

Et si vous n’y arrivez pas
En cas d’échec, n’en faites pas une défaite personnelle. Tentez plutôt de trouver pourquoi vous n’avez pas réussi. Ce n’est sans doute que partie remise. De toute manière, rappelez-vous que seule résolution sur dix est encore d’actualité douze mois plus tard, selon une étude du professeur Richard Wiseman.

In 2008 while the lucrative holiday period drew near, luxury watch production had slowed, brought to heel by the global financial crisis. Since mid-2008, exports declined and unemployment rose, with notices of staff reductions being announced by large multinationals each month.

In Neuchatel where a large number of luxury brands are located, the manufacturer Ulysee Nardin had to fire 12% of its 25o man work force and produced at a slower rate.

But since September, according to the management, the ateliers are running at 100% with orders rising and the company has ended its practice of partial unemployment.

Ulysse Nardin has inaugurated a new boutique in Beijing and the Neuchatel-based luxury watch maker seems braced for renewed good times. The director of the company, Rolf Schnyder, recently stated recently that the company would end the year in the black, albeit with less profit than last year. 2008 had started off very well for the Ulysse Nardin but finished off badly. 2009 started off badly and has apparently finished well.

The Director’s prognostic is that the recession has ended and that growth has returned, with November sales 30% higher than those for November 2008.

Nonetheless, Mr. Schnyder believes that the United States will take much more time to recover, and their market is important for the luxury watch maker; that said, the importance of the US market has declined from 30% historically to currently 18%.

An unstated reason for the return to health is that the company is operating with a smaller workforce, which, for the moment, the company does not seem in a rush to rehire.

Additionally, with the rise in orders, their production capacities cannot keep up. The various subcontractors upon which the luxury brands depend – for watch casings, dials and other parts– let go substantial numbers of staff over the past year and do not have the resources to produce at the old capacity levels. They probably are also wary about too rapidly hiring back staff.

Also, despite the return of strong sales, the distribution of sales has nonetheless changed, with a marked decline in sales of super expensive pieces and a concomitant rise in sales of moderately priced pieces.

The phenomenon is identical in China and in the United States. Ulysse Nardin’s director believes that the worst is also passed in the United States and the economy is recovering, though it will be a longer road to elsewhere. Besides the US and China, Russia is also an important market for the luxury brands, as well as the middle east, though with the financial crisis in Dubai, sales have dropped by 70%. A large part of the luxury watch maker’s sales figures this year in Spain, Italy, Turkey or Florida has come from Russian tourists.
